1. Why do I need a Maritime Jones Act lawyer?
1. What is the Jones Act?
The Jones Act, 46 U.S.C. Section 30104 et seq., is a law that is still favorable to an injured worker. It applies to all persons that are involved in the maritime offshore industry or inland waterway river commerce system. It applies to the fishing, fishery, canning, shrimping, oil field, dredging, barge, tugboat, towboat, crew boat, supply boat, drill ship, platform, oil rig and other maritime offshore industries. The Jones Act allows you to actually sue your maritime employer for negligence and/or “unseaworthiness” for any injuries you suffer including, a back injury, neck injury, herniated disc, brain injury, burn injuries, hurt shoulders and knees, inhalation injuries and wrongful death claims. The fact that you can sue your employer is the major difference between the Jones Act and workers compensation claims.
2. What Is “Unseaworthiness” or “Unseaworthy”?
As indicated above, you can sue your employer for negligence or you can allege that a piece of equipment was unseaworthy and that was a cause of your injury. But what is unseaworthiness? Literally, it means that the particular piece of equipment “is not fit for its intended purpose”.
3. You can also sue under a theory of negligence.
In addition to “unseaworthiness” as a theory of recovery under the Jones Act, you can also sue the employer alleging that a crewmember was negligent and that was the cause of your injuries.
4. What is “Maintenance” and Medical “Cure”?
This is an obligation that is owed to you directly from your employer and is different from the Jones Act. Maintenance is an obligation to pay you a daily amount while you are injured and usually is an amount equal to the cost of lodging and food when you were aboard the vessel. It varies. We have seen it as low as $8.00 a day and as high as $50.00 a day. Medical “Cure” is reasonable and necessary medical care that the employer must pay you until you reach maximum medical improvement [MMI].
There are three (3) main points that Gordon, Elias & Seely, L.L.P. wants you to understand about Maintenance and Cure. First, they not only apply to injuries suffered while working but also to illness. Second, unlike the Jones Act, they should be paid regardless of fault. In this sense they are very akin to workers compensation. Third, if the employer wrongfully refuses to pay them, the maritime employer can be liable for punitive damages as well as attorneys’ fees.
5. “Comparative Negligence” Applies Under Jones Act
Another concept to understand about the Jones Act is that it applies the legal doctrine of “comparative negligence”. Under a “comparative negligence” approach, the jury hears testimony about the negligent conduct of both parties–the employer and the maritime worker. Based on the evidence, the jury will determine what the injured party’s damages are and how much should be allocated to each party. Sometimes accidents happen not just from the employers’ negligence but also from the seaman’s as well. The good thing about “comparative negligence” is, even though the jury may find a percentage of negligence on the worker, the injured worker still recovers the percentage of the jury’s monetary award that is equal to the employers’ percentage of negligence. By way of example only, if the worker is found 25% negligent and the employer is found 75% negligent and the jury awards $875,000.00, then the judgment would be that the worker recovers $656,250.00 plus costs. This is quite different than in almost all states where, if the injured person is found 51% or more negligent by the jury, the injured person would recover zero no matter how much the jury awarded for money damages.
6. When Must I file Suit?
The Statute of Limitations in a Jones Act claim is three (3) years from the date of injury. A Jones Act lawsuit must be filed within three (3) years of the injury date or it is barred by the Statute of Limitations.
As you can see, a maritime claim is a very specialized area and should only be handled by lawyers who know what to do.

2006 Cincinnati Reds Preview
2005 Overview:
The biggest news for Cincinnati Reds fans in 2005 was the fact that Ken Griffey Jr.(.301 35 92) was able to play an entire season injury free for the first time in over 5 full seasons. What was so impressive about Griffey’s 2005 performance was his ability to completely return to form, hitting for both power and average. Griffey grabbed the Comeback Player of the Year Award for his outstanding efforts.
The rest of the Reds 2005 offense was provided by Adam Dunn (.247 40 101), veteran 2nd baseman Rich Aurilia (.282 14 68) and outfielder Austin Kearns (.240 18 67). Unfortunately, the Reds starting pitching didn’t offer many wins in 2005. Starters Aaron Harang (11 13 3.83), Brandon Claussen (10-11 4.21) and Ramon Ortiz (9 11 5.36) joined Eric Milton (8 15 6.47) and closer David Weathers (7-4 3.94 15 saves) to handle the majority of the pitching duties during the season. Weathers’ was picked up from the Mets and was converted into a full-time closer we he nailed down 15 out of 19 save opportunities. No real staff Ace emerged in 2005 with Harang leading the rotation with 11 wins. The Reds ended the season with a less then impressive final 73-89 record, finishing 27 games behind the NL Central Champion St. Louis Cardinals.
Off Season Moves:
The Reds recognized pitching as their main priority during the off season so they traded away popular first baseman Sean Casey to the Pittsburgh Pirates for left handed starter Dave Williams (10-11 4.41). Unfortunately the Reds did little else to address their starting pitching needs. Veteran Infielder Rich Aurilia re-signed, and Cincinnati also traded for utility man Tony Womack (.249 in 2005), which was designed to give the team some options off the bench in 2006. Lefthander reliever Chris Hammond (5-1 3.84) also signed on from the defending NL West Champion Padres.
2006 Analysis:
Expect Adam Dunn now to move over to first base, leaving the outfield responsibilities to Austin Kearns, Ken Griffey Jr. and Wily Mo Pena. The Reds really didn’t significantly address the starting pitching in the off season and the one new starting pitcher they acquired (Williams) will hardly make a difference for the team in 2006. With Harang leading the group with only 11 wins there is a bunch of work to be done before the Reds can hope to contend. Williams was only a 10 game winner in 2005 so fans shouldn’t expect much from him either.
Like many major league teams, the Reds are relying heavily on their youngsters which include Kearns, Pena, Dunn, shortstop Felipe Lopez, and Ryan Freel. Fans were happy to get the old Griffey back in 2005 and are hopeful he will pick up where he left off when he starts the 2006 season. Dave Weathers is simply not a strong closer although the team managed to squeeze 15 saves out of him last season. Hammond was a nice pick up and should help out a struggling bullpen – but even more help is needed. Cincinnati Reds fans should expect more of the same in 2006.

Philadelphia Phillies vs. Milwaukee Brewers

The Philadelphia Phillies ended their longest winning streak since a 13 game streak in 1991. Glavine pitched seven strong innings and drove in a pair of runs to help the New York Mets beat Philadelphia 13-4 Wednesday night, snapping the Phillies nine-game winning streak.
It had been quite a turnaround for the Phillies, who opened 1-6 and finished 10-14 in April. The winning streak began on April 30 with a 5-1 victory in Pittsburgh that avoided a three-game sweep against the woeful Pirates.
“We just have to throw this one out the window and bounce back tomorrow,” Phillies manager Charlie Manuel said.
In other news Cole Hamels is no longer only in Philadelphia’s future plans. The Phillies will call up the 22-year-old Hamels, their first-round pick in 2002, to make his major league debut Friday against the Cincinnati Reds and the Phillies hope this new prospect will help them to get a place in the playoffs.

Milwaukee didn’t have a good time against the Padres last week. Losing on Wednesday night 3-0 in a game that was completely dominated by Chan Ho Park who didn’t allowed any runs in the 6 innings he pitched.
Park credited outfielders Mike Cameron and Brian Giles for making great catches. “And also, I had a good catcher back there calling the right pitches, so that helps and makes me more comfortable and confident,” Park said.
The Brewers that have a 17-17 record were playing really good baseball up until they faced the Padres, which outplay them in two of the three games of the series. The Brewers had a phenomenal season start but lately they’re in a hole and might get down the .500 average.
Milwaukee will face this week against Philadelphia in a series that will be very exciting, since both teams need to win. Expect nothing but great baseball games between these two in this series. If you like sports’ betting this is a great opportunity to give more emotion to the All-American sport by making some bets on the series.

The Angels Are Flying High In The West!
The Los Angeles Angels have fired off the loudest shot in week one of the second half of the major league season and that is bad news for the Oakland A’s and the Texas Rangers. The halos have now won 11 of their past 12 games and have taken their record above .500 (46-45) for the first time since April 28th.
If they want to contend they will need the continued support of several key players such as Rob Quinlan, Howie Kendrick, Kendry Morales and tonight’s emergency starter Dustin Moseley. This team has battled through numerous injuries with Escobar, Erstad, McPherson and new sensation rookie pitcher Jered Weaver.
The White Sox have a major problem with Freddy Garcia which makes me wonder if they will go across town to Wrigley and scoop up veteran thrower Greg Maddux. Garcia has allowed a team-high 22 homers in 19 starts and his ERA is an unflattering 5.07.
Where has the Red Sox pitching gone or maybe a better question is have they returned from the All-Star break? Oakland hammered Boston taking 3 of 4 and outscoring them 28-15. Their acquisition of Kyle Snyder from the Royals has been a disaster and his ERA in 2 starts is 10.03.
The Atlanta Braves have won the NL East 14 times in a row and they are intent on making a second-half charge. Their reign is over as division champs as the Mets have an insurmountable lead, but they are only 5 back in the wild card. The Braves tore apart the Petco Park record book, Jones hit a 424-foot, and a two-run homer in the fourth to tie the record of 14 straight games with an extra-base hit set in 1927 by Pittsburgh’s Paul Waner.
Chipper Jones’ third homer of the series and 14th this year helped the Braves to a sweep of the series. He hit two in Friday night’s 15-12, 11-inning win which was the highest-scoring game in Petco’s three-year history.
Brian McCann also homered Sunday for the Braves giving them 11 in the series — a Petco record for one team. The 16 total homers were also a Petco record eclipsing the 14 hit by the Mariners and Padres June 23-25.
The Braves scored 36 runs — a ballpark mark — on 43 hits in the series including nine doubles. The teams combined for 56 runs — also a Petco record — on 82 hits.

Should I Go Back To School Or Keep Trying To Find A Job?
I obtained a degree in fine arts (I know it was not a wise choice but I can’t really take it back now) this past spring. Since then I have been trying to find a job doing anything that involves some type of creativity or even a clerical or administration job, but I can’t find anything. I turn in resumes with cover letters and I don’t even get a response. It has been five months since I graduated. I can not move away from this area (pittsburgh) because I have inherited a house here. My loan repayments (17k) are going to start coming in at the end of October and all I have is a crappy sales job that pays 8$ an hour which I can not live off of especially with these repayments. Should I keep trying to look for a job that I may never get or should I start looking at vocational schools? I already went through four years of school and don’t want to go that much longer. I could also work more than 40 hrs a week but my job really sucks and is very depressing. I know my decision is ultimately up to me but I just wanted to get some opinions on what I should do. I did not foresee the economy slowing down. I am almost living at poverty level, so I know I could get a lot of financial aid for school but I would still go into more debt in loans.
